Request for special judge entered in Sheriff Gladieux case

FORT WAYNE, Ind. (Fort Wayne’s NBC) — The Indiana Supreme Court has given an update in the case of Allen County Sheriff Dave Gladieux.

Fort Wayne’s NBC previously reported that a class A misdemeanor for battery has been filed against Sheriff Gladieux after a physical confrontation with a teenage volunteer at the Three Rivers Festival in July.

Gladieux was ordered pay a $334 fee and make a public apology, although he denies the battery allegation. He will also complete an alcohol treatment program and anger management program. Once he completes the programs, the charge will be dropped.

An Outreach Coordinator for the Indiana Supreme Court has confirmed with Fort Wayne’s NBC that a request for a special judge was filed on Friday.

The request for a special judge is intended to avoid potential conflicts of interest that could arise if an Allen County judge were to oversee the case. A similar action was taken during the investigation, when Rodney Cummings from Madison County was named Special Prosecutor.

According to a tort claim notice filed by the victim’s family, the victim asked to see Gladieux’s badge after he entered an area of the festival that was closed down for the evening.

The notice says Gladieux responded, “I am the f****** Sheriff, move out of my way.”

The teen insisted on seeing his badge, because he said he did not believe he was the real Allen County Sheriff because he smelled of alcohol. He said Gladieux briefly held up the badge then dropped it, and the tort claim notice says Gladieux then pushed the teen “very hard” to the ground.
